1. Scope of Services
The Agency shall provide recruitment services to the Candidate, including but not limited to job placements, resume reviews, interview preparation, and career counseling. The Candidate acknowledges that the Agency has the sole discretion to select job opportunities and make placements.
2. Candidate Obligations
The Candidate agrees to:
- Actively pursue job opportunities as advised by the Agency.
- Provide accurate and complete information regarding their qualifications and employment history.
- Communicate promptly with the Agency regarding job applications and interviews.
- Notify the Agency immediately upon accepting any job offer.
3. Confidentiality
The Candidate agrees to maintain the confidentiality of all proprietary information related to the Agency, including but not limited to client lists, placement details, and recruitment strategies. This obligation shall survive the termination of this Agreement.
4. Fees
The Candidate acknowledges that any fees incurred for services provided by the Agency are the responsibility of the Candidate, unless otherwise specified. The Candidate agrees to pay any fees due to the Agency within 30 days of invoicing.
5. Duration
This Agreement shall commence on the date first written above and shall remain in effect until terminated by either party with 30 days' written notice. The Agency reserves the right to terminate this Agreement immediately for cause.
6. Dispute Resolution
Any disputes arising under this Agreement shall be resolved through binding arbitration in Uttarakhand, in accordance with the rules of BDS Recruitment Pvt Ltd. The Candidate agrees to bear the costs of arbitration unless otherwise determined by the arbitrator.
7. Limitation of Liability
The Agency shall not be liable for any indirect, incidental, or consequential damages arising from the Candidate’s use of the Agency’s services. The Candidate acknowledges that the Agency does not guarantee job placement or employment.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Uttarakhand.
